Foreign death certificates in New York courts
New York's civil practice rule CPLR 2101(b) requires a foreign-language document filed in court to be accompanied by an English translation and a statement from the translator setting out their qualifications and attesting that the translation is accurate. A foreign death certificate attached to a probate or administration petition needs exactly that.
Since 2024, New York has allowed most sworn statements to be made as an affirmation under penalty of perjury rather than before a notary, but some courts and practitioners still prefer a notarized affidavit. Ask the attorney handling the estate which the court wants; if it is a notarized affidavit, we can notarize the translator's statement at our office.
An NYC death certificate going abroad
For an estate or pension abroad, an NYC death certificate takes the same route as an NYC birth certificate: ordered from the Department of Health together with a Letter of Exemplification, authenticated by the New York County Clerk, then apostilled by the Department of State. The apostilled certificate is then translated.
